What is Delta-8 THC?
Delta-8 THC is a naturally occurring cannabinoid found in small amounts in hemp plants. It produces mild psychoactive effects — roughly half as potent as Delta-9 THC. Most commercial Delta-8 is synthesized from CBD through chemical conversion. It became widely popular after the 2018 Farm Bill created a legal gray area for hemp-derived cannabinoids.
Federal Status
Currently sold in the 2018 Farm Bill's hemp gray area. Because nearly all commercial Delta-8 is synthesized from CBD, Section 781 of the 2026 law excludes it from the definition of hemp as a cannabinoid manufactured outside the plant — making it a federally controlled substance on November 12, 2026, regardless of the total-THC math.
