Current legal status
Delta-8 THC is restricted in Tennessee, not freely sold. Public Chapter 526 / HB 1376 (2025) moved hemp-derived cannabinoid products to the Alcoholic Beverage Commission (TABC) effective January 1, 2026: sales are limited to TABC-licensed retailers, in person only, with per-serving THC caps and a 21+ age requirement, and a total-THC standard that pushes many higher-potency Delta-8 products off the shelf. Some sources characterize the total-THC standard as an effective ban.
