Hemp-derived Delta-9 refers to products made from hemp that contain less than 0.3% Delta-9 THC by dry weight — which allows for significant amounts of THC per serving in edibles and beverages (a heavy gummy can contain 5-10mg while staying under 0.3% by total weight).
Federal Status
The 2026 law adds a cap of 0.4 mg of total THC per container on finished products. Hemp Delta-9 edibles and beverages typically carry 5–15 mg per serving — 12 to 37 times over the cap — so they lose hemp status and become federally controlled substances on November 12, 2026. Only trace products at or under 0.4 mg per container stay compliant.
