Federal Status

The 2026 law adds a cap of 0.4 mg of total THC per container on finished products. Hemp Delta-9 edibles and beverages typically carry 5–15 mg per serving — 12 to 37 times over the cap — so they lose hemp status and become federally controlled substances on November 12, 2026. Only trace products at or under 0.4 mg per container stay compliant.
