Note: Delaware takes a strict approach to hemp-derived cannabinoids. Only non-intoxicating CBD products are permitted outside the medical cannabis program; Delta-8 and all synthetic cannabinoids are explicitly banned. HB 373, a bill regulating THC-infused beverages (no more than 10 mg per container, sold through package stores, 21+), passed both chambers in early July 2026 and is pending governor signature as of July 18, 2026; beverages remain banned until it is signed.
