L. 119-37), effective November 12, 2026, layers a federal 0.4 mg total-THC-per-container cap on top of state enforcement, removing the remaining retail path for Delta-8, Delta-9, and similar products and pushing any surviving market toward the licensed cannabis system.

A HITA preliminary injunction was denied June 25, 2025 (appeal pending), and the fix bill SB 1702 died. Products remain on some shelves, but treating them as fully "legal" is indefensible.
