Federal Law Change โ€” November 12, 2026

South Dakota already bans chemically converted cannabinoids such as Delta-8 under HB 1125 but still permits naturally derived hemp Delta-9 products. Section 781 of H.R. 5371 (Continuing Appropriations and Extensions Act, 2026, Pub. L. 119-37), effective November 12, 2026, imposes a 0.4 mg total-THC-per-container cap that will significantly restrict the remaining naturally derived hemp THC market, so the impact is high.

Note: South Dakota banned chemically modified and converted hemp cannabinoids (Delta-8, HHC, Delta-10, THC-O) under HB 1125, effective July 1, 2024, with enforcement sweeps since July 14, 2025. Naturally derived hemp Delta-9 and CBD products remain available, and THCA is unsettled. The state was one of the later adopters of hemp and had a contentious relationship with cannabis legalization.
