2026 Federal Law Impact on Pennsylvania

Pennsylvania has a well-established, largely unregulated hemp market. Section 781 of H.R. 5371 (Continuing Appropriations and Extensions Act, 2026, Pub. L. 119-37), effective November 12, 2026, imposes a 0.4 mg total-THC-per-container cap that will significantly reduce the availability of Delta-8 and similar intoxicating products, though non-intoxicating CBD is likely to remain largely unaffected.

Note: Pennsylvania regulates hemp under Act 92 of 2016 and has no dedicated cannabinoid-product statute: SB 49, which sought to license and tax hemp products, failed in June 2026, so Act 92 of 2016 remains the operative framework. There is no statutory purchase-age minimum for hemp products. Hemp-derived products are widely available in gas stations, smoke shops, and specialty stores throughout the state, overseen by the PA Department of Agriculture.
