⚠️RestrictedNote: Montana bans synthetic and chemically converted hemp cannabinoids (delta-8, delta-10, HHC, THC-O, THCP) under HB 948 (2023), even inside the licensed adult-use market it created in 2020 (I-190). SB 375 (2025) bars retail sale of any hemp product with detectable THC outside licensed dispensaries, and HB 49 (2025) caps compliant finished products at 0.5 mg total THC per serving and 2 mg per package — limits that took roughly 80–90% of intoxicating hemp gummies and drinks off Montana shelves. Only non-intoxicating CBD and topicals remain broadly available at general retail. Earlier versions of this entry cited a bill that never became law; the operative statutes are HB 948, SB 375, and HB 49.
