L. 119-37) — signed November 12, 2025, effective November 12, 2026 — redefines hemp with a 0.4 mg total-THC-per-container cap and excludes artificially derived cannabinoids. Minnesota's roughly $200 million lower-potency hemp edible market allows 5 mg-per-serving products — well above the federal 0.4 mg per-container cap — so the enacted rider removes most of the state's general-retail hemp edibles and beverages, a high-impact change.

Full federal ban details →Note: Minnesota did not force all THC into the licensed cannabis system. Its lower-potency hemp edible (LPHE) market — delta-8 and delta-9 expressly allowed, capped at 5 mg per serving and 50 mg per package (beverages ≤10 mg per container) — is legal at general retail, liquor stores, and bars for adults 21+. The MDH-era registration sunset March 31, 2026; since April 1, 2026 businesses operate under Office of Cannabis Management (OCM) licenses. Governing law is Minn. Stat. ch. 342. HHC is banned in consumables, and inhalable forms go through the licensed cannabis system.
