L. 119-37) — signed November 12, 2025, effective November 12, 2026 — redefines hemp with a 0.4 mg total-THC-per-container cap and excludes artificially derived cannabinoids. Michigan already confines hemp-derived THC to its licensed marijuana market, so the federal cap is largely absorbed by the state's existing Cannabis Regulatory Agency framework — a moderate impact.

PA 87 and PA 56 (2021) placed all hemp-derived THC, including THCA, under the Cannabis Regulatory Agency, so intoxicating hemp cannabinoids may be sold only by licensed marijuana businesses, not general retailers, gas stations, or smoke shops. Non-intoxicating CBD remains available at general retail. An October 2025 bill package (HB 5040 and related bills) was not enacted.
