L. 119-37) — signed November 12, 2025, effective November 12, 2026 — redefines hemp with a 0.4 mg total-THC-per-container cap and excludes artificially derived cannabinoids. Maryland already channels intoxicating hemp into its licensed cannabis market, so the federal cap largely reinforces the state's post-Moore limits — a moderate impact absorbed by the existing dispensary framework.
Full federal ban details →Note: Maryland legalized adult-use cannabis in 2023 and has folded intoxicating hemp into the licensed cannabis market. In Moore v. Maryland Hemp Coalition (Sept 9, 2025), the appellate court reversed a lower-court injunction: delta-8 and delta-10 are illegal outside licensed dispensaries, and general retailers may sell only products at or below 0.5 mg THC per serving and 2.5 mg per package. Non-intoxicating CBD remains available at general retail.
