Section 781 of H.R. 5371 (Continuing Appropriations and Extensions Act, 2026, Pub. L. 119-37) — signed November 12, 2025, effective November 12, 2026 — redefines hemp with a 0.4 mg total-THC-per-container cap and excludes artificially derived cannabinoids. Louisiana already runs a capped, registered hemp market (5 mg total THC per serving); the federal 0.4 mg per-container cap is far stricter and removes most compliant edibles and beverages from retail, though the state's existing licensing structure could adapt — a moderate impact.

Note: Louisiana regulates hemp-derived cannabinoids under a chain of statutes — Act 336 (2021), Act 498 (2022), and Act 752 (2024, effective Jan 1, 2025). Consumable hemp is capped at 5 mg total THC per serving and 40 mg per package, beverages are limited to one serving per container, products require testing and labeling, sales are restricted to adults 21+, and gas stations and similar outlets are barred. Inhalable and smokable hemp — flower and vapes — has been prohibited since 2021, and there is no retail path for high-THCA hemp. HB 12 and HB 36 (2025) added criminal penalties tied to under-21 sales.
