Note: Kentucky has one of the longest hemp-cultivation histories in the U.S. and a permissive market: delta-8 and other hemp-derived cannabinoids are legal for adults 21+ under HB 544. Hemp beverages are the exception — SB 202 (2025) limits them to 5 mg THC per 12 oz serving under Alcoholic Beverage Control oversight and, since June 1, 2025, to alcohol-licensed retailers, while HB 775 (2025) imposes spirits-level excise taxes and licensing.
