✅Legal2026 Federal Law Impact on Kansas
Section 781 of H.R. 5371 (Continuing Appropriations and Extensions Act, 2026, Pub. L. 119-37) — signed November 12, 2025, effective November 12, 2026 — redefines hemp with a 0.4 mg total-THC-per-container cap and excludes artificially derived cannabinoids. Kansas relies entirely on the federal Farm Bill definition for its hemp market; the cap and the exclusion of artificially derived cannabinoids sharply narrow the compliant products available in a state with no cannabis program — a high-impact change.
Full federal ban details →Note: Kansas has no adult-use or comprehensive medical cannabis program, so hemp is the main access point for cannabinoid products — but the market is more restricted than it appears. Attorney General Opinion 2021-14 treats delta-8 as a Schedule I controlled substance unless it contains no more than 0.3% total THC, and K.S.A. 2-3901(b)(5) bans hemp cigarettes and products intended for smoking or vaping outright. Compliant hemp products at or below 0.3% total THC remain legal. Kansas sets no statutory hemp age minimum (SB 292 remained in committee).
