Indiana's large, loosely regulated hemp market depends on the federal Farm Bill definition, so the cap and the exclusion of artificially derived cannabinoids remove most delta-8 and edible products from retail — a high-impact change for the state.

Smokable hemp flower is banned under IC 35-48-4-10.1 (in effect since 2019), which also reaches high-THCA flower, and vape legality is unsettled. Delta-8's status is contested: Attorney General Opinion 2023-1 (non-binding) treats it as a controlled substance, though products remain widely sold. Indiana sets no statutory hemp age minimum. Reform bills SB 478 (2025) and SB 250 (2026) both failed.
