Section 781 of H.R. 5371 (Continuing Appropriations and Extensions Act, 2026, Pub. L. 119-37) — signed November 12, 2025, effective November 12, 2026 — redefines hemp with a 0.4 mg total-THC-per-container cap and excludes artificially derived cannabinoids. Illinois's currently unregulated intoxicating hemp market is large, and the federal cap coincides with SB 3222's own November 12, 2026 reclassification of these products as cannabis; together they remove intoxicating hemp from general retail, a high-impact change for Illinois consumers and retailers.

Intoxicating hemp-derived cannabinoids (delta-8, delta-9, THCA, HHC, delta-10) remained unregulated at general retail until SB 3222 (signed June 12, 2026), which immediately restricted sales to adults 21+. Effective November 12, 2026, SB 3222 reclassifies intoxicating hemp as cannabis under the Cannabis Regulation and Tax Act — after that date only non-intoxicating CBD products under 0.4 mg total THC per container may be sold outside licensed dispensaries. Chicago's proposed local ban was vetoed by Mayor Johnson in February 2026.
