Federal Law Change — November 12, 2026

Arkansas already prohibits intoxicating hemp-derived cannabinoids under Act 629 (2023) and Act 934 (2025), enforced statewide since the Eighth Circuit's June 24, 2025 ruling. Section 781 of H.R. 5371 (Pub. Note: Act 629 (2023, SB 358) banned Delta-8, Delta-10, and other converted intoxicating hemp cannabinoids as Schedule VI substances; Act 934 (2025) added a total-THC basis and placed enforcement with the Arkansas Tobacco Control Board. The Eighth Circuit vacated the injunction on June 24, 2025 (Bio Gen v. Sanders), and thousands of products have been seized since. Non-intoxicating CBD remains legal.
